Gathering storm for reverse payment settlements

Dennis Crouch reviewed Michael Carrier’s book on IP vs. Antitrust law. It seems that Mr. Carrier takes the view that reverse settlements (where a pharmaceutical company pays a generic to stay off the market) should be illegal. This practice was discussed at a HIPLA CLE earlier this year (the last Flemings lunch, I believe). It’s a touchy subject because companies are, in effect, extending their patent rights through negotiation and contracts. The other side argues...

AIPLA Student Representative

I’ve been selected as the AIPLA student representative for the University of Houston Law Center. It turns out that the AIPLA co-chairs, Christopher McKeon and Jesse Ormsby, both attend UH so my role would be to support their initiatives as well as facilitate some speaking engagements of my own. It’s quite an honor and I look forward to the work.

Today I attended a class from the Practicing Law Institute on Green Technology and Business Law. This course was offered at PLI’s headquarters on 7th Avenue in NYC. Topics ranged from venture capitalization of emerging technologies to intellectual property of recycling/reusing to cap and trade. The class was recorded for future webcasting and I must wholeheartedly recommend it. The speakers ranged from lawyers to money men to deal makers and it was invaluable to...

I had the opportunity to attend a seminar on Maximizing IP Value in an economic downturn this morning, courtesy of Fish & Richardson. I’ll touch on the highlights. James Babineau spoke about streamlining patent filing and prosecution through electronic filing, provisionals, PCT as first filing, etc. Most importantly, he cautioned to stop at every step and think about the value of the patent. He also recommended that a company shirk obsolete or unused...

Meta Data: Is it public record?

Interesting article from K&L Gates about a recent decision in Arizona (Lake v. City of Phoenix, 2009 WL 73256 (Ariz. Ct. App. Jan. 13, 2009) distinguishing between a written document and the meta data therein. The court decided that the meta data did not serve the purpose of public record and thus was not required to be maintained by the city or turned over during discovery. This decision flies in the face of the Washington ruling that classified meta data as public record (O’Neill v....

HIPLA Luncheon on Electronic Discovery

I attended a presentation from Mary Lou Flynn-DuPart of Jackson Walker LLP today. This was a HIPLA-sponsored luncheon with the topic of electronic discovery, a heightened area of interest for me, given my background in efficiency management. A couple of good tips: parcel the work up by custodian, rather than just breaking it up piecemeal. In other words, better to play man-to-man than zone when reviewing documents. Also, watch for time stamps, especially when collecting...

I have to hand it to PLI. They run a solid shop for passing the Patent Bar. And little did I know they offer scholarships. When I saw a Green Technology class posting, I inquired about a student discount. They said they offer full scholarships and invited me to apply. I did, and low and behold I won it. So I'm off to NYC in February to learn about Strategies for Finance, Carbon Trading, IT, and Carbon Neutral Policies.

I attended this year's HIPLA conference over the weekend. Anthony Matheny did an excellent job of rescheduling as a result of Hurricane Ike. The event was held at the Omni in Houston. The majority of the speakers were excellent. Some of the speakers of note to me were Joe Beauchamp of Jones Day who talked about inevitable disclosure. The key behind that is to get your in-house council involved during talks of hiring away from a competitor. Get a contract in...
